TERMS OF USE AGREEMENT

These Terms of Service (“Terms”) govern your use of this website provided by Happy Dog. By accessing this site, you acknowledge and agree to abide by these Terms. These Terms may be updated at any time at our sole discretion, and continued use of the site after changes are made constitutes your acceptance of the revised Terms.

Please read the Arbitration and Waiver of Class Actions section carefully, as it affects how disputes are resolved. By accessing or using this site, you acknowledge you understand and accept this binding arbitration agreement.

SHIPPING INFORMATION

At Happy Dog, we work hard to process your order quickly.

Order Processing Times (Eastern Standard Time - EST):

  • Orders placed before 2:00 PM EST, Monday–Friday (excluding holidays), will be processed the same business day.

  • Orders placed after 2:00 PM EST will be processed on the next business day.

  • Orders placed after 2:00 PM EST on Fridays will ship the following Monday (unless it is a postal holiday).

  • During high-demand periods or promotions, processing may take up to 72 hours.

Available Shipping Methods:

  • Free Shipping (5–8 business days) – via USPS

  • USPS Ground Advantage (3–7 business days) – via USPS

  • Priority Mail (1–3 business days) – via USPS

  • FedEx 2-Day Air (2 business days) – No Saturday or Sunday delivery

  • FedEx Overnight (1 business day) – No Saturday or Sunday delivery

Note: Delivery timelines are estimated and not guaranteed. Shipping charges are non-refundable. Business days do not include weekends or holidays.

We do not currently ship to U.S. Territories or APO/FPO addresses.

FREE SHIPPING (50 U.S. STATES ONLY)

Free shipping typically arrives within 5–8 business days. Deliveries to Alaska and Hawaii may take 2–3 additional days.

USPS GROUND ADVANTAGE

Orders placed by 1:00 PM EST ship the same business day. Transit time is 3–7 business days, varying by location. For example, orders shipped to Florida may arrive in 1–3 business days, whereas shipments to more remote areas may take longer.

All USPS rates are real-time and shown at checkout. A valid, verifiable street address is required for delivery. If the address is incorrect, shipment may be delayed until confirmed.

Important: Free USPS delivery is not guaranteed. If lost or delayed, you must contact your local post office. For guaranteed delivery, choose FedEx.

PRIORITY MAIL (USPS)

Orders placed before 2:00 PM EST will ship the same day, with 2–3 business day delivery (possibly faster within Florida). Orders placed after this cutoff will ship the next business day.

UPS 2-DAY AIR

Orders placed before 1:00 PM EST will ship the same business day. Transit time is 2 business days. Orders placed after 1:00 PM EST on Friday will arrive the following Tuesday or Wednesday.

UPS OVERNIGHT

Orders placed before 1:00 PM EST will ship the same day, with next-business-day delivery. Orders placed after the Friday cutoff will arrive on Monday or Tuesday.

SHIPPING RATES

All domestic rates are pulled in real-time from USPS. International shipments (if available) are processed via FedEx International and may incur a flat rate based on destination.

30-DAY GUARANTEE & RETURNS

You may return unopened or minimally used products in their original packaging within 30 days of your order date for a refund.

  • Contact us at hello@happydogwellness.co for eligibility.

  • Returns for damaged/defective products may require photo evidence before a return label is issued.

  • Promotional returns must include all items or have the promo value deducted from the refund.

  • Non-defective returns must be shipped at your expense.

To process a return:

  1. Visit the return link on our site with your order number and email.

  2. Print the prepaid return label if applicable.

  3. Repackage items properly using USPS-provided padded envelopes or boxes.

  4. Include your packing list and note your refund or exchange request.

Refunds process in 3–5 business days once we receive the returned product. Final credit may take up to 5 business days to appear in your account.

USE RESTRICTIONS

You may only use this site for lawful, personal purposes. You may not:

  • Co-brand, frame, or hyperlink without permission.

  • Republish or redistribute content without written consent.

  • Use automated tools to access the site.

INTELLECTUAL PROPERTY

All content on this site is owned by Happy Dog or its licensors. You may not copy, modify, or distribute this content unless explicitly permitted.

THIRD-PARTY LINKS

Links to third-party sites are provided for convenience only. Happy Dog is not responsible for the content or security of those websites.

USER SUBMISSIONS

You grant Happy Dog a royalty-free, perpetual, irrevocable right to use any content you submit, including ideas, comments, or suggestions. We are not obligated to treat submissions as confidential unless required by our Privacy Policy.

DISCLAIMERS

We do not guarantee the site or its contents are virus-free or error-free. All content is provided “as is” without warranties of any kind. You assume full responsibility for any loss or damage from use of this site.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Happy Dog is not liable for any direct, indirect, incidental, or consequential damages exceeding $100 or the amount paid for the product in question.

INDEMNITY

You agree to indemnify Happy Dog and its affiliates from any claims or losses resulting from your misuse of this site or breach of these Terms.

TRADEMARKS

All trademarks and logos are the property of Happy Dog or its affiliates/licensors.

PROHIBITED CONTENT

You may not post content that is illegal, harmful, defamatory, infringing, or otherwise violates these Terms. Happy Dog reserves the right to remove any content at its discretion.

SECURITY

You are responsible for your login credentials. Unauthorized use of this site’s security tools is prohibited. We may cooperate with law enforcement in case of violations.

MISCELLANEOUS

These Terms are governed by the laws of Florida, USA. Exclusive jurisdiction lies in the courts of Florida. If any part is found unenforceable, the rest shall remain in effect.

PRODUCT DISCLAIMER

These statements have not been evaluated by the Food and Drug Administration. This product is intended for intermittent or supplemental feeding only and is not intended to diagnose, treat, cure, or prevent any disease.

Consult your veterinarian before using this product, especially if your pet has a medical condition, is taking medication, is pregnant or lactating. Discontinue use immediately if any adverse reactions occur.

Keep out of reach of children and animals. In case of accidental overdose, contact a veterinarian or animal poison control center immediately.

Store in a cool, dry place. For animal use only.

ARBITRATION AGREEMENT

You and Happy Dog agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of our website, or the purchase of any products shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise provided below.

Arbitration will be conducted in Miami, Florida, before a single arbitrator, and administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, including the Expedited Procedures, as applicable. Judgment on the arbitration award may be entered in any court with jurisdiction.

This arbitration agreement is governed by the Federal Arbitration Act and evidences a transaction involving interstate commerce.

Exceptions:

You or Happy Dog may choose to bring an individual claim in small claims court in Miami-Dade County, Florida, if the claim qualifies. We will submit to binding arbitration in all other cases.

Waiver of Class Actions:

You and Happy Dog agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of a representative or class proceeding.

If a court determines that the class action waiver is unenforceable, this entire arbitration section will be null and void, and the dispute will proceed in court.

No Jury Trial:

If for any reason a dispute proceeds in court rather than through arbitration, you and Happy Dog waive any right to a jury trial.

Confidentiality:

All arbitration proceedings, including the hearing, testimony, and documents, will remain confidential, except as required by law or to enforce an arbitration award.

Format of Hearings:

Hearings may be conducted virtually unless the arbitrator determines that an in-person hearing in Miami, Florida is appropriate due to travel limitations or other relevant factors.

Discovery Limitations:

In any arbitration under this agreement, there shall be no interrogatories or requests for admission. The arbitrator may not award punitive, incidental, indirect, or consequential damages, including lost profits, unless such damages are expressly allowed by statute.
